Pennsylvania Still Can’t Legalize. Jersey’s Border Dispos Are Cool With That.

Pennsylvania left legal weed out of the budget for the fourth year in a row. Here’s what that means for Jersey’s border shops, and what PA shoppers need to know.

For the fourth year in a row, Pennsylvania's governor asked for legal weed, and for the fourth year in a row, it didn't happen. If you've ever been to a dispo in Phillipsburg, Camden County, or anywhere near a bridge, you already know who's been picking up the slack.

What happened in PA

  • Legal weed was left out of Pennsylvania's $50.8 billion budget, approved July 13, 2026
  • Gov. Josh Shapiro has pushed for it every year since 2023
  • The PA House passed a bill last year (102-101) for state-run weed stores, but the Republican Senate wouldn't move it
  • A bipartisan Senate bill for private dispensaries has been stuck in committee
  • Shapiro's opponent in this year's governor's race, State Treasurer Stacy Garrity, has said she'd veto any cannabis bill

PA Senate Democrats held a hearing on it as recently as September 25, but nothing's moving before the election.

How much money PA is leaving on the table

PA's own budget office estimates legal weed would bring in about $432 million a year in taxes by 2030-31. Other estimates put first-year sales over $2 billion. Meanwhile, the legal states around PA (New Jersey, New York, Maryland, Delaware, and Ohio) are doing close to $5 billion a year in rec sales combined. West Virginia is the only neighbor that isn't legal.

What it means for New Jersey

New Jersey was the first state on PA's border to open rec sales, and a lot of Pennsylvanians never looked back. Nobody publishes exact numbers on how many PA residents shop here, but if you've been in a dispo by the Delaware River on a Saturday, you've seen the PA plates.

For NJ border shops, a legal PA would mean losing a big chunk of customers overnight. Every year PA stalls is another year those stores keep that business. That matters in a market where prices keep falling and shops are fighting for every customer.

If you're coming over from PA, read this

  • You can buy here if you're 21+ with a valid ID. You can have up to 6 ounces in NJ.
  • You can't take it home. Bringing weed across state lines is illegal under federal law, even from one legal state to another, and any amount of rec weed is still illegal in PA.
  • PA penalties are real: up to a $500 fine and 30 days in jail for a first offense on small amounts, and more over 30 grams. Philly decriminalized small amounts, but state police on the highways don't follow Philly's rules.
  • You can't smoke in public here either. Your options are a private residence with permission or one of NJ's five consumption lounges.

My take

Pennsylvanians are already buying weed in New Jersey or from the unregulated market, so the ban mostly decides which state collects the taxes. Right now that's us, and that's a pretty good deal for Jersey.

The real test is the governor's race in November. If Garrity wins, legal weed in PA is probably off the table for years.
