California Can Now Pull Weed Off the Shelf and Retest It. Why Can’t Jersey?

California can now grab a jar off any dispensary shelf and retest it. New Jersey’s plan is a $50,000 data review. Here’s why that gap matters.

In my lab shopping report I broke down how New Jersey is finally investigating whether the THC numbers on our jars are real. A week later, California went a step further, and it makes our plan look kind of soft.

What California just did

On September 27, California's governor signed AB 1965. It passed both houses without a single no vote (73-0 and 39-0). Here's what it does:

  • The state can take products straight off dispensary shelves and send them to an independent lab to see if they match what the label says
  • Dispensaries have to give you the COA if you ask for it
  • Regulators can run blind tests on the labs themselves, sending them samples to see if they get the right answer

That last one is huge. It's basically a secret shopper for testing labs.

What New Jersey is doing instead

NJ's plan is to hire an outside expert to study testing data that's already been reported. Twice a year they'll look for patterns: labs with suspiciously high THC numbers, results clustering right under the mold limit, stuff like that. Proposals for that contract are due October 22, and the budget is capped at $50,000.

Data analysis is useful. It's how we found out average THCA jumped from 24.5% to 27.81% in two years and that three labs were doing almost 95% of the testing. But data only tells you what the labs reported. It can't tell you what's actually in the jar you bought on Friday.

Why shelf testing matters

Think about how testing works right now. A batch gets tested once, before it hits the shelf. If the lab is soft on mold or generous with THC, that's the number that follows the product forever. Nobody checks again.

Shelf testing closes that gap. If the state can grab any jar at any dispensary and retest it, every brand and every lab has to assume their numbers might get checked. That changes behavior fast.

It also catches stuff that happens after testing, like flower that sat too long, got stored wrong, or (like the Garden State Exotix case at the last CRC meeting) got opened and repackaged.

What I'd want to see in NJ

  1. Random shelf pulls from dispensaries across the state, retested by a lab with no stake in the result
  2. Blind proficiency testing of every licensed lab
  3. A COA-on-request rule written into the regs so every dispensary hands it over without a fight
  4. Public results, so we can see which brands and labs held up

The CRC already has the evidence that something's off. The data review is a good first step. Shelf testing is how you actually prove it.
